Solar Exclusive, LLC (“Solar Exclusive,” “we,” “our,” or “us”) is a marketing company that generates unique, quality leads for solar businesses across the nation. We strive to increase the customer base and reach of solar companies by providing exclusive leads that result in long term customers.
We at Solar Exclusive respect privacy and are committed to protecting personal information. This Privacy Policy (“Policy”) describes the types of personal information we collect; why we collect it; how we collect personal information; use personal information, and disclose personal information; and any available rights and choices associated with that information.
This Policy applies to the personal information we collect when you use any of the services that we offer (our “Services”), including visits to our websites, including cleanenergyassociation.org, solarexclusive.com, solarexclusive.org, and proof.solarexclusive.com, web and mobile applications, and other web-connected services (together, the “Site”).
This Policy does not apply to third-party websites, products or services, even if they link to the Site. 1. COLLECTION OF PERSONAL INFORMATION
As described in this Privacy Policy, we may collect and store certain personal information from or about you in order to provide, enhance, market, and offer our services to you. This section describes the categories of personal information we may collect or we may have collected in the preceding 12 months. For the purposes of this Privacy Policy, “personal information” generally includes information that we collect that may be used to identify you specifically.
You may not be required to provide all of the personal information identified in this Policy to access or use the Site and Services. However, please be advised that if you do not provide personal information requested by us, we may be unable to provide some or all of the Services to you. We only collect personal information in accordance with applicable law.

Personal information you may provide to us through the Site, in connection with our Services, or otherwise includes:
• Contact information. When you fill out on online webform on our Site or otherwise contact us, we may ask for certain contact information, such as your first and last name, email address, and phone number.

We, our service providers, and our client partners may automatically log information about you, your computer or mobile device, your activity over time on the Site and other online services, and your interactions with our marketing communications such as:
• Device information. We may collect information such as your device’s operating system type and version, manufacture, and model, browser type, screen resolution, device type (e.g., phone, tablet), IP address, language settings, mobile device carrier, radio/network information (e.g., WiFi, LTE, 3G), and geolocation data.
• Online activity information. Pages or screens you viewed, how long you spent on a page or screen, the website you visited before the Site, navigation paths between pages or screens, information about your activity on a page or screen, access times, and duration of access, and whether you have opened our marketing emails or clicked links within them.
c. Aggregated, De-identified, or Anonymous Data
We may create aggregated, de-identified, or anonymous information from personal information by removing certain data components (such as your first and last name, email address, or linkable tracking ID) that makes the data identifiable, or through aggregation, obfuscation, or other means. For example, we may use aggregated, de-identified, or anonymized information to understand how to improve or enhance the Site. Subject to applicable law, our use of such aggregated, de-identified, or anonymized information is not personal information subject to this Policy.
2. USE OF PERSONAL INFORMATION
We use personal information for the following purposes:

We use your personal information to provide, operate, and improve the Service, to communicate with you about the Site and Services, to respond to your inquiries or requests for information, to understand your needs and interests, and personalize your experience with the Site and Service and our communications; and provide support for the Service.

We and our third-party advertising partners may collect and use your personal information for marketing and advertising purposes: We may use your personal information, such as your email address or phone number, to send you content, surveys, news, or to otherwise contact you about our Services or information we think may interest you. You may opt-out of our marketing communications as described in the section titled Your Choices below.
• Interest-based advertising. We may contract with third-party advertising and social media companies to display ads on the Site. These companies may use cookies and similar technologies to collect information about you (including the data described in the automatic data collection section above) over time across our Service and other online services, and use that information to serve ads that they think will interest you. 3. DISCLOSURE OF PERSONAL INFORMATION

• Affiliates. Subsidiaries and affiliates, for purposes consistent with this Privacy Policy.
• Our service providers. Companies and individuals that provide services on our behalf or help us operate the Site or Services or our business (such as information technology, hosting, customer relationship management and support, communications delivery, marketing, advertising, and website analytics).
• Our client partners. We share personal information, either directly or through intermediary agents and/or entities (including, lead aggregators and vendors to such businesses), with third parties that are our clients, such as product/service providers, marketers of such products/services, and/or affiliate companies, including as determined by the price such third party entity is willing to pay for the information (collectively, including intermediaries, “Client Partners”). For example, we may share personal information with Client Partners for their direct marketing purposes. We may also share personal information with Client Partners at a point in time after it is initially collected. In all such instances, we serve as the Client Partner’s service provider and only collect, use, and share personal information as directed by them and for their exclusive benefit.
• Third party advertising platforms. Third party advertising companies that collect information about your activity on the Site or Services and other online services to help us advertise our Service, and/or use customer lists that we share with them to deliver ads on their platforms on our behalf to those customers and similar users.
• Affiliate and business transferees. If we are involved in a merger, reorganization, dissolution or other fundamental corporate change, or sell a website or business unit, or if all or a portion of our business, assets or stock are acquired by a third party. In accordance with applicable laws, we will use reasonable efforts to notify you of any transfer of personal information to an unaffiliated third party.
• Authorities and others. Law enforcement, government authorities, and private parties, as we believe in good faith to be necessary or appropriate for the compliance and protection purposes described above.
4. YOUR CHOICES
You have certain choices with respect to your personal information.
• Opt-out of marketing communications. We may use your contact information to send you e-mail messages regarding updates to the Site, such as the publication of new Solar Exclusive information and content, promotional offers, or to communicate with you about your use of the Site. You may opt-out of receiving these emails by following the unsubscribe link contained in the email message, or by contacting us at info@solarexclusive.com. Please be advised that you may not be able to opt-out of receiving certain messages from us, including legal notices.
• Rights based on your state of residency. Residents of certain states may have additional or different rights as described elsewhere in this Privacy Policy.

5. DATA SECURITY
We have taken steps to secure and protect your personal information from loss, unauthorized access, unauthorized disclosure, misuse, destruction, or alteration. However, there is always some risk involved in transmitting information over the Internet, and we cannot fully eliminate security risks associated with the storage and transmission of personal information.
6. COOKIES AND TRACKING
a. Usage Info and Cookies
When you access the Site, our servers automatically collect and record the Internet Protocol (“IP”) address associated with your computer. We may also collect additional information such as a device ID, browser type and version, the operating system of your device and language, country, as well as the date and time of visits, your IP address, the pages viewed, time spent on the Site, and the web sites visited just before and just after the Site. This information is used to help us administer the Site. This information may be appended to your profile information to remember your preferences and diagnose technical problems.
To collect this information, we use cookies. Cookies are small data files sent by a website and stored on the computer or device at the request of that site. Cookies store information related to a user's browser to enable us to recognize your device on return visits to the Site and to remember your preferences.
Most browsers allow you to control cookies, including whether or not to accept them and how to remove them. If you want to block the use and saving of cookies from the Site onto the computer’s hard drive, you should take the necessary steps within your web browser’s settings to block all cookies from the Site and external serving vendors. We may also use web beacons, pixels, or similar collection mechanisms, and in certain circumstances may collect IP address, screen resolution, and browser software and operating system types, clickstream patterns, dates and times that our site is accessed, and other categories of data.
b. Do-Not-Track
The Site does not support Do-Not-Track functionality. Do-Not-Track is a preference you can set on your web browser to inform websites that you do not want to be “tracked’ by third parties. We do not respond to Do-Not-Track Signals as we do not track you when you leave the Site. Our third party service providers, who provide ad serving, retargeting services, and web analytics services to us, may not respond to Do-Not-Track signals. If you come to the Site with a Do-Not-Track signal enabled on such user's browser, we do not look for the Do-Not-Track signal or respond to it.
c. Interest-Based Advertising
We do not display advertisements on the Site but we do participate in interest-based advertising to place advertisements on unaffiliated sites using information you provide us when you interact with the Site. Interest-based ads, also known as personalized ads, are ads that are targeted to you based on your web browsing and app usage over time and across websites or apps. For example, we may use third-party ad servers, retargeting services, and web analytics systems, such as Google, to analyze aggregate web usage statistics and provide us the ability to display advertisements about our services to you when you have left our site.
You have the option to restrict the use of information for interest-based advertising and to opt-out of receiving interest-based ads. Some of these third parties may use cookies and other technologies to collect information about your online activities over time and across third party websites or online services to deliver advertising based on your interests and preferences, as inferred from your browsing history. Some of these ads may be personalized, meaning that they are intended to be relevant to you based on information that those third parties collect about your visits to this site and elsewhere over time.

7. LINKS TO OTHER WEBSITES
The Site contains links to other websites, including social networking websites, mobile applications, or Internet locations (collectively “Third-Party Sites”). The fact that we link to a website is not an endorsement or representation of an affiliation with that website. We have no control over and are not responsible for third party websites, their privacy practices, their content, or any goods or services available through the Third-Party Sites. This Policy Statement does not apply to Third-Party Sites; any information you provide to a Third-Party Site is subject to that Third-Party Site’s privacy policy or privacy statement. We recommend that you carefully review applicable privacy policies or privacy statements before using or engaging with any Third-Party Site.
The Site may also include social network sharing widgets that may provide information to their associated social networks or third-parties about your interactions with our web pages that you visit, even if you do not click on or otherwise interact with the plug-in or widget. 8. CHILDREN’S PRIVACY
The Site and the Services offered are not directed to or intended for use by children under the age of 16. We do not knowingly collect or solicit Personal Information from anyone under the age of 16, or knowingly allow such persons to register for our services. If we learn that we have inadvertently collected Personal Information from an individual under age 16, we will delete that data promptly. 9. INTERNATIONAL DATA TRANSFERS.
The Site is operated in the United States. If you are located outside of the United States, any information you provide to us will be transferred to, processed, and/or maintained in the United States. If you are located outside of the United States, the transfer of Personal Information may be necessary to provide you with the requested information and the Services and/or to perform any requested transaction.
10. CALIFORNIA PRIVACY NOTICE
This California Privacy Notice supplements information contained in our Policy and applies to any California residents about whom we have collected personal information from any source, including offline, and through your use of the Site or the Services.
We provide this California Privacy Notice to comply with applicable privacy laws in the State of California, including the California Consumer Privacy Act of 2018, and its amendment, the California Privacy Rights Act of 2020 (together, the “CCPA”).

Please note that because of the overlapping nature of certain of the categories of personal information identified above, which are required by state law, some of the personal information we collect may be reasonably classified under multiple categories.

We may collect, use, or disclose personal information about California residents for the purposes listed in Section 2 of this Policy,

• From you, including, for example, from forms you complete when registering for the Services, surveys that you take, or as automatically collected when using the Site or Services.
• Through our service providers, third party companies who help us provide the Site and Services to you consistent with this Privacy Policy.
We may supplement the personal information collected from the categories of sources described above with personal information we obtain from other sources.
d. Disclosure of Personal Information
We may disclose your personal information to the categories of service providers and third parties identified in Section 3 of this Privacy Policy, and in ways that are described in that section.
We “sell”/“share” personal information as those terms are defined by the CCPA, but only in the context of sharing your personal information with third party advertising platforms to facilitate targeted digital advertising, as detailed in Section 3 of this Privacy Policy and as further detailed below.

e. Your Privacy Rights
Subject to certain exceptions and limitations, if you are a California resident, you may have the following rights under applicable California law in relation to your personal information:
• Right to Know. You may have the right to, up to twice in a 12-month period, request what personal information we collect, use, share, disclose, and/or sell/share, as applicable. You may request either a report disclosing the general categories of the personal information we collect, or a report disclosing the specific pieces of personal information we collect.
• Right to Delete. You may have the right to request under certain circumstances the deletion of your personal information that is collected by us from you.
• Right to Correct. You have the right to request the correction of your inaccurate personal information.
• Right to Limit Use and Disclosure. You have the right to limit the use or disclosure of your sensitive personal information to only the uses necessary for us to provide our products and services to you, or for certain other authorized purposes.
• Right to Opt-Out of Sale/Sharing. You may have the right to opt-out of the sale/sharing of your personal information by a business, as those terms are defined under California law.
• Right to Non-Discrimination. You have the right not to receive discriminatory treatment for the exercise of the privacy rights described above.
How to submit a request. Subject to various exclusions and exceptions under applicable laws, you may exercise any of the rights described in this section by contacting us by email at info@solarexclusive.com or at the following address: 9550 S Eastern Ave. Ste. 253 Las Vegas, NV 89123.
Responses. Any request you submit to us is subject to an identification and residency verification process (“Verifiable Consumer Request”) as permitted by the CCPA. We cannot fulfill your request unless you have provided sufficient information (including your first and last name and email address) that allows us to reasonably verify that you are the consumer about whom we collected the personal information. You may only make a Verifiable Consumer Request twice within a 12-month period.
The CCPA requires that we confirm receipt of your request within ten (10) business days. We will respond to your request within forty-five (45) days upon receipt of a Verifiable Consumer Request. We reserve the right to extend the response time by an additional forty-five (45) days when reasonably necessary, provided that consumer notification of the extension is made within the first forty-five (45) days.
If we cannot verify your identity to a degree of certainty as required by the CCPA through any reasonable method, we will state in writing that we are unable to verify you and provide a reason as to why there is no reasonable method by which we can verify your identity.
Authorized agents. You may also designate an authorized agent, in writing or through a power of attorney, to request to exercise the above rights on your behalf. If you use an authorized agent to exercise your various rights under the CCPA, we may require that you provide your authorized agent with written permission to exercise your various rights and to verify your own identity with us. If your authorized agent does not submit proof that they have been authorized by you to submit verified requests for disclosure and deletion, we reserve the right to deny such a request that we have received and we will explain to your authorized agent why we have denied such request. The authorized agent may submit a request to exercise these rights by emailing the letter of authorization or power of attorney to us, as described in How to Submit a Request. If the authorized agent does so by email, they should include proof of their authorization to submit the request on your behalf in their email.
f. Notice of the Right to Opt-Out
Solar Exclusive “sells”/”shares” personal information as those terms are defined under California law, only to the extent we disclose personal information to third parties for purposes of cross-context behavioral advertising, as defined under California law. Accordingly, we offer you the ability to opt out of the sale and/or sharing of your personal information.
If you have not yet opted out of the sale/sharing of your personal information, please do so by completing any of the following steps to fully effectuate your request:
• Submit the Do Not Sell/Share Personal Information form. The information you provide in the form, if needed, will facilitate your request to opt-out of sale/sharing. If you do not provide the information requested below, we may not be able to identify you and process your request to opt-out. Any information you provide below will not be used, disclosed, or retained for any purpose other than processing the request to opt-out of sale/sharing.
Please note that your cookie-based preferences may not be effective when accessing our websites from another device or browser, or if you have recently cleared your cookies. We encourage you to express these preferences again from your other devices or browsers, or after you have cleared your cookies, as needed.
Also please note that your use of our Sites may still be tracked by Solar Exclusive and/or our service providers, to the extent it does not involve sales/sharing.
The CCPA requires that we state that we do not have actual knowledge that we have sold/shared personal information of individuals under 16 years of age.
11. NEVADA PRIVACY NOTICE
Pursuant to Section 603A of the Nevada Revised Statutes, residents of Nevada may, at any time, submit a request to an operator of a website in Nevada directing the operator not to make any sale of any personal information the operator has collected or will collect about the consumer. If you are a Nevada resident and want to opt-out of the sale of any personal information, please submit an email request to info@solarexclusive.com. In your request, please specify that you want to “Opt-Out of Sale of Personal Information in Nevada.” Please allow sixty (60) days for a response.
12. VIRGINIA PRIVACY NOTICE
This Virginia Privacy Notice supplements information contained in our Privacy Policy and applies to any Virginia residents about whom we have collected personal data from any source, including offline, and through your use of the Site or the Services. This section does not apply to data processed or maintained for individuals applying to, employed by, or acting as agents or independent contractors of the Solar Exclusive within the context of those roles. For purposes of this section, “personal data” means any information that is linked or reasonably linkable to an identified or identifiable natural person. Personal data does not include de-identified data or publicly available information.
For purposes of this section, “publicly available information” means information that is lawfully made available through federal, state, or local government records, or information that a business has a reasonable basis to believe is lawfully made available to the general public through widely distributed media, by the consumer, or by a person to whom the consumer has disclosed the information, unless the consumer has restricted the information to a specific audience.

• Right to Access. You may have the right to request under certain circumstances what personal data we collect, which may include requests to obtain a copy of such data in a portable and readily usable format.
• Right to Delete. You may have the right to request under certain circumstances the deletion of your personal data that is collected by us from you.
• Right to Correct. You have the right to request the correction of personal data that you believe to be inaccurate.
• Right to Opt-Out of Sale/Sharing. You may have the right to opt-out of the sale/sharing of your personal information by a business, as those terms are defined under California law. You may Opt-Out of the sale/sharing of your personal information by submitting the Do Not Sell/Share Personal Information form.
Children. If we have collected personal data on your minor child, you may exercise the above rights on behalf of your minor child. Please note that our Services are for a general audience and we do not knowingly collect any personal data from children younger than the age of thirteen (13).

Please note that not all requests can be fulfilled because of obligations under federal, state, and local law as well as applicable regulatory and legal requirements.
Responses. The above rights are subject to our being able to reasonably verify your identity and authority to make these requests. These rights are also subject to various exclusions and exceptions under applicable laws.
We will verify your identity by using data you provide, such your first and last name and email address. These data elements will be compared against our records for verification.

13. CHANGES TO THIS POLICY
This Policy is current as of the Effective Date set forth above. We may change this Policy from time to time, so please be sure to check back periodically. We will post any changes to this Policy on the Site at solarexclusive.com/privacy.
